Update: TBA Action to defend the rule of law? Nonexistent

I’ve gotten some requests from folks for an update on my latest post. On a day when Trump’s FBI has arrested a judge in Wisconsin for alleged obstruction of the efforts of ICE to arrest someone in a courthouse, it seems like a good day to update.

The TBA remains steadfast in deciding to remain silent. My last day as a TBA member will be May 31. At least one entire law firm has gone a step further and resigned membership from the TBA rather than just not renewing. If you agree with the sentiment I have expressed here on my blog, or that the Donati Law Firm has elaborated upon with even more urgency in their letter, then now is probably a good time (if you haven’t already) to let the TBA know your thoughts on the consequences of silence.

As to the Memphis Bar Association though, I am heartened to have learned that the MBA intends to issue a public statement on Law Day, May 1, 2025. I look forward to hearing it and am hopeful it will make MBA members proud to continue to support that organization.

If you are reading this from outside of Tennessee, I hope the bar associations that you are voluntarily a part of are standing up for the rule of law and vigorously doing what they can to protect lawyers and judges alike from the threat of authoritarianism. If not, I would suggest you also do what you can to try to make your voice heard.
